Dealer sold vehicle fraudulently

I bought a vehicle from John Pillay, a motor dealer at 368 Commissioner St  Jhb. The vehicle had 80 461km on the odometer at the time of purchase. I specifically asked if the vehicle had been in any serious accidents and was assured by John Pillay that the AA Roadworthy Report would disclose that information. He then told me there were no major accidents. I requested the service history of the vehicle, which he promised to provide, but never did. After buying the vehicle cash, I requested the service history of the vehicle from Toyota, and was shocked to discover that at the last service, 5 months prior to my purchasing the vehicle, the odometer of the vehicle showed a milage of 210 988km. After contacting the previous owners of the vehicle, who's details appeared on the service history, I discovered that not only had the odometer been tampered with, but that the vehicle was written off  shortly after that service. I checked the engine number of the vehicle, and it was correct, so the engine had not been replaced which would have accounted for the discrepency in milage. The previous owners were insured by Santam who sold the vehicle to Bonerts, who in turn sold it to a business aquaintance of John Pillay, who happens to run his business on the same premisis as John Pillay. I confronted John Pillay with this information and requested a full refund. He told m e he would have to resell the vehicle in order to recover the funds. I told him I want nothing to do with a fraudulent transaction. since then he has done nothing but make empty promises, avoid my calls, and tell staff to inform me he is not available - strangely I have heard his voice in the bvackround. When we have caught him off guard at  his place of, work, we get one story after another, the latest being that he has had a deal approved for the resale of my vehicle through a particular finance house. When I called the finance house, they confirmed that there never was any such deal. I have heard nothing from John Pillay since then, even though I have sent messages imploring him to contact me so we can sort out this problem. This has been going on for three months now. I wonder how many more unsatisfied customers John Pillay has out there, getting absolutely no results from him? Is this how an honest honerable person conducts business????

    Believe me Matt, the law is one thing but on a practical level its extremely difficult to extract your money from someone who is an accomplished criminal. I have been fighting a civil case against John Pillay for 19 months now. Finally we are getting somewhere, and I will get my money back with interest and costs!! He greatly underestimated me, as he is finding out!!! I also have a criminal case against him which will bring the necessary results soon. Don't touch the stock he has whatever you do!!!!

    Glad i saw this. Was intersted in a Golf 6 R the price seemed a bit low fpr the milage. I asked for the VIN number, but no reply. These crooks should be locked up.     Coline Whatever mann Hi guys Rose my worry now is that this people advertise their products on what I would say is a reputable site like, automark and autotrader, and again what about those that are just excited about getting a car bf they do a research? How do we help them? because I was also about to send thing to coline bf i decided let me google them? and again weeks back when I started looking for a car I got John Pillays numbers from above massioned sites but under a different name. And Thanks to report a crime site doing this.

    Thank you very much people.I was about to buy a car from Mr Pillay. Thanks God I came across this page. I have sent him an email requesting him to stop with the applications. I am a bit worried on what he might do with my, Id,drivers L,Payslips and the application for that I signed and sent back to him. Thank you again for the warning.     I'm really pleased that the one good thing that has come from this bad experience is that others have seen these comments, and have been spared the trauma of going through the same nightmare that we have gone through since buying this vehicle!! Be very careful, and have your second hand vehicle thoroughly checked before you buy it, and if it does not have a service record, do not take a chance and buy it, because the manufacturer will not service a vehicle thats odometer has been tampered with. The vehicle cannot be traded in and neither can you sell it privately. It really is a huge problem and will cause you a lot of heartache!

    Mokgadi, my best advice to you is to go and lay a complaint at the Jeppe Police Station where they will advise you further. It is my understanding that many people who have been victims of John, have done so, and are slowly getting their money back. I wish you everything of the best.

    Nobody has accused you of any crime, but unfortunately if you work for somebody who has a reputation for fraudulent and unethical sales or business practises, your name is associated with him and his business. If you are so dead against the crimes he is associated with, why do you work for him? You cannot roll in the mud and expect to stay clean!!!! The crime site is put in place to warn and protect innocent consumers against people who engage in unscrupulous business practises. And if you work for him, then you must proudly represent his company!!!!

    itz very painfull when someone put your name on crime report.i do not want my name there.she was supposed to put company's name not my name how would you feel if somebody put your name on crime report it's bad i did nothing wrong for everything that happened last it has northing to do with me because i was not here.i started to work here after.i don't know what happed to that.

    Oh WOW coline!!!! LOL!!!! In Nina's defence, she never said one derogatory word against you, nor did she call you dodgey! She said the PLACE looks dodgey! She simply mentioned that she spoke to you regarding a vehicle and that you must work for John Pillay! And if you take exception to that, then why do you work for him? You cannot sue her for that!!!!!

    Rather spend a bit more money and buy a vehicle from a reputable dealer who is registered with the IDA - Independent Dealers Ass and with the Motor Ombutsman. If a dealer has not registered with these organizations, they cannot assist you at all with any problems you may encounter. The Consumer Protection Board is so inundated with complaints in the vehicle department that they cannot cope. I submitted my complaint more than a year ago, on following up they confirmed receipt of my complaint, but I have heard nothing since. I can lay a criminal charge of fraud against Mr Pillay with the police, but his colleague informed me that he has 'friends' in the police department that can make the case files disappear. The only other thing is to sue him ,but this is very costly and time consuming, and the outcome is not guaranteed. Pay a little extra and have the vehicle assessed by the AA, they will give you a 9 page detailed report on the car. You can do this before you purchase the vehicle. Request a service history from the manufacturer (the previous owners details are on record - contact them for information on accidents etc.) Be wise and save yourself a load of heartache and frustrration and a stack of money.     Thanks alot! So Mr Pillay he is the owner? I spoke to the guy by the name Collins Mphela, m sure he work for him. And again what can be done about their business being advertised on car sales website like automark? I mean if they proven to be untrustworthy why is automark still doing business with them. I think something must be done because not everyone thinks of doing a research about the seller before they buy. Thank again Rose

    Whatever you do don't purchase a vehicle from Mr Pillay. The AA where he has his vehicles roadworthied informed us that he only buys vehicles that have been written off, from scrapyards, and rebuilds them in a shoddy fashion. There is nothing wrong in selling rebuilt vehicles as long as you are informed of what you are buying. Mr Pillay denies his vehicles have been in an accident, and where its obvious, he will tell you the vehicle had a minor ding.On more than one occasion has been caught out selling vehicles with the odometers turned back ,as well as vehicles that's engines have seized only a few days after purchase. It is never his fault according to him ,and you will be lucky if he even answers your call once you have encountered problems with the vehicle. We even discovered that he had swopped the 15 inch mag rim spare wheel for a 14 inch rim on our vehicle - something we didn't think to check before purchasing the vehicle. Also a number of wheel nuts were missing. He did not even bother to fix the problems with the vehicle noted on the AA roadworthy report. Once he had our money, that was all he was interested in. Carte Blanche does not expose someone just because of one disgruntled customer. Mr Pillay was exposed by them in Nov last year, and as a result thereof all of the financial houses and banks closed their doors to doing business with him. I don't know how he is still in business!!!! Please be warned!!!!!

    Hi Zayne, did you not receive a purchase agreement that may cover you with some sort of warrenty? I'm not sure what your legal rights are if you did not. The only thing I can suggest to you is to try and find out and decide what further action to take. You could try the consumer board, but they have a long waiting list of complaints, especially in the motor vehicle department. You could lodge a complaint with the motor ombutsman if the dealer is a registered member. Alternatively you could phone the AA's legal department for advice on how to further proceed. Or contact Speakout or Carte Blanche with your complaint and hopefully you can get your story out there, if only to warn others so they don't fall into the same trap,and taken advantage of by these thugs.

    Thank you for your reply. You will be pleased to know that after some investigation I discovered more people were defrauded by John Pillay. On 24 November with the help of Carte Blanche I and one other, who was prepared to go on camera, exposed him when the programe was aired. I believe he has not done well since then- nobody wants to do business with him!!!! I am in the process of suing him at the moment and still intend to laqy a criminal charge of fraud against him. It amazes me how he continues to blame his suppliers for the fraud and remains adament that this is the first time anything like this has ever happened to him.

    not much to say , reading the above story , john pillay - Fitz trading enterprise cc did exactly the same thing to my daughter with a golf gti , turned out it was a right off that was rebuilt which we found out to late as we took him for his word , and all turned out to be lies - beware !!!!!!!!!!
